Clery Act: Campus Security Reporting Requirements

The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act): Reporting Requirements

Federal law requires the University to prepare an annual report about certain crimes reported to campus officials with significant responsibility for student and campus activities. Some faculty and staff based upon their semester assignment report or job description, are considered a campus official to whom the reporting requirements apply.

The actions required of them to comply with the Higher Education Act of 1965 are straightforward and will not be time-consuming. These actions are the following:

  1. They are to contact Lt. Joe Sharkey (392-1114) with the University Police Department if someone informs them that a particular crime has occurred
    1. on campus, or
    2. in off-campus buildings or property owned or controlled by the University or by a University recognized student group, or
    3. on public streets and sidewalks immediately adjacent to the campus.
  2. The particular crimes that trigger the reporting requirements are described on the document entitled “Reporting Emergencies or Crime on Campus,” available from the University Police department.   3. When Lt. Sharkey is called, he will ask the caller to provide the information contained on the “Crimes Statistic Report Form”, available from UPD.

Callers will not be required to fill out the Crimes Statistic Report Form. Rather, they will provide the information that has been reported to Lt. Sharkey, who will then fill out the Crimes Statistic Report Form.

The information provided to Lt. Sharkey is to be included in a statistical report. Please note that callers will not be asked to identify the victim or the perpetrator of the crime that was reported. Please encourage the person who reports the crime to contact UPD directly and, if appropriate, to seek the services of the University’s Student Health Care Center, Counseling Center, Office of Victim Services, or Office of the Ombudsman. Of course, first-hand knowledge of the occurrence of the crime (as opposed to a report of a crime from someone else), should be reported immediately to UPD at 911.

It is important that Lt. Sharkey be contacted promptly if one of the enumerated crimes is reported. The information provided is required to be included in the University’s annual campus security report. Failing to provide information that is reported could adversely impact the accuracy of the University’s campus security report. Under the Higher Education Act, if the University is found to have substantially misrepresented the number, location, or nature of crimes reported to campus officials, the University may be subject to a fine of up to $25,000.00 for each misrepresentation or violation.
